Where’s the Crime?
Last year, 9 U.S. Attorneys were fired. This year, subpoenas have been issued, testimony heard, and contempt citations urged. Were the attorneys fired because of their race? No. Were they fired because of their gender? No. Disability? No. Sexual preference? No. Age? No. They were fired because the President no longer wanted to employ them. So, where’s the crime?
Much of the media either does not understand what “serving at the will of the president” means or intentionally does not report the fact that U.S. Attorneys serve at the will of the president. When someone serves at the will of the president, the president can fire that person for any reason so long as the person’s civil rights are not violated. A person may not be fired due to race, gender, disability, age, and maybe sexual preference. The Congressional investigation into these firings centers on whether the U.S. Attorneys were fired for political reasons. Being fired for political beliefs is not a violation of civil rights. Therefore, no crime has been committed.
The fact that no crime has been committed appears to be lost on most reporters and on a substantial number of congressmen. If a U.S. Attorney had walked into the Oval Office and the President did not like the attorney’s tie, the President can fire him. If the attorney wore offensive perfume, the President can fire her. The involvement of the President, his advisors, the Attorney General, and others in the Justice Department is wholly irrelevant, and so are the President’s reasons for firing these attorneys. Congress does not have the constitutional authority to oversee the President’s management of his executive branch staff. Once the Senate has advised and consented to the presidential appointment, their constitutional involvement in employment matters is complete. Congress is not the Executive Branch’s human resources division, and it is time for Congress to stop attempting to usurp the president’s power over his employees.
